I think this is the first step in a number of delays and backtracking the FDA will be doing.  Looking at the current appropriations bill in the House (HR3268) there is no funding for enforcement.  The Senate version does not have that same provision but still the bills will need to be conferenced between the two bodies

Nirab is right, CRA does a great job looking after our rights, but it cant end there.  You yourself needs to be and active participant.  Contact your Representative and two Senators. They would rather hear from you.  Most congressman have simple forms for emailing on their website.  You don't need to be overly formal or articulate, just let them know you them to support this cause.

Being from Florida, I guess I shouldn't have expected anything else, but I should have shared their responses here.  Basically, they were all like "oh don't worry, we are all over this!"  I just thought it was funny when I got their responses and it was such an overwhelming "we agree 100% and are already fighting this".

There are two additional pieces of legislation that could play even a greater roll in stopping the FDA

House bill H.R.564 titled To amend the Federal Food, Drug, and Cosmetic Act to clarify the Food and Drug Administration’s jurisdiction over certain tobacco products, and to protect jobs and small businesses involved in the sale, manufacturing and distribution of traditional and premium cigars. is currently before the 155th House.  The bill has 130 cosponsors.  Details can be read here -

Senate bill S.294 is the same measure for the Senate.  There are 15 co-sponsors

If your Rep or Senator is a sponsor write them and thank them, if not write them and encourage them to jump aboard.

This ruling basically kicked the can down the road until the next election, where a possibly more draconian administration may take over.  We need decisive action,not delaying tactics while we still have a somewhat amenable administration in place.

The bills mentioned in last test put in place specific exemption for premium cigars from the FDA, where the House appropriates bill mentioned in other threads simply does not allow for the FDA to use operational funding for enforcing the deeming rules.  Seems to be these two bills would be more effective.
